Suit can't continue against hospital, Michael Jackson
|
|
A judge in Santa Maria ruled Tuesday that a
lawsuit filed against pop star Michael Jackson and Marian
Medical Center cannot continue in court as filed.
The suit was filed by the family of a Santa
Maria woman who died at the hospital shortly after she was
moved to another room to make space for the entertainer to
be examined.
Judge Rodney Melville of Santa Barbara County
Superior Court, who was also the judge in Jackson's child-molestation
case two and a half years ago, granted demurrers filed by
attorneys for Jackson and Marian Medical Center. He also gave
the attorney for the plaintiffs, San Luis Obispo-based James
McKiernan, 30 days in which to file a re-drafted complaint.
McKiernan immediately said he would re-file
the necessary documents.
A demurrer is a pleading that attacks the legal
sufficiency of an opponent's pleadings.
The complaint, filed in February, alleges abuse
of celebrity status and blames Marian Medical Center and Jackson
for the “outrageous, circus-like atmosphere they orchestrated
during the last hours of Manuela Ruiz's life and its obvious
emotional and mental lasting effects upon the plaintiffs.”
The plaintiffs, mostly children of Manuela Gomez
Ruiz, are seeking undetermined damages. They allege intentional
infliction of emotional distress, negligent infliction of
emotional distress, elder abuse, false imprisonment and conspiracy
on the part of Jackson, Marian Medical Center and Catholic
Healthcare West, which owns the hospital.
During his trial, which ultimately resulted
in his acquittal on child-molestation charges, Jackson was
taken to Marian Feb. 15, 2005, complaining of flu-like symptoms.
Ruiz, a 73-year-old woman who was on life-support
after a massive heart attack, was moved from a two-bed trauma
room so that Jackson could privately occupy the room, according
to the plaintiffs' complaint.
Ruiz was moved to an exam room, while kept alive
by hand-pumped oxygen, until she could be reconnected to life-support
machines. She had another heart attack, but milling crowds
delayed her arrival at the critical-care unit, according to
the complaint. She died later that evening.
During the hearing Tuesday, the attorney for
the hospital, Santa Barbara-based Hugh Spackman, argued that
facts alleged in the case were filed under an ill-fitting
cause of action.
McKiernan, attorney for the plaintiffs, defended
the allegations in the complaint as being based on an “outrageous
set of facts,” and he described the events surrounding
Jackson's hospital stay as “highly unusual.”
Outside court after Melville's granting of the
demurrers, McKiernan said the judge didn't find that Jackson
or the hospital had a duty to Ruiz's relatives.
McKiernan said he will file a re-drafted complaint
in the case.
“We're always confident in our work,”
he said.
Spackman and the attorney representing Jackson
in the case, Timothy Gorry of Los Angeles, declined to comment
on the judge's ruling.

Will.i.am
Interview
|
|
An interview of singer and producer Will.i.am
by the German newspaper 'Süddeutsche Zeitung' has been
published by the web site jetzt.de.
SZ: So what's your opinion as a businessman:
Will the new Michael-Jackson-album, which you take part in,
be a success? Will it ever appear at all?
Will.i.am: I think it will appear. But to all the rest: no
comment. The deal between Michael Jackson and me is pretty
simple: Whenever he calls I get into the studio with him.
There have been already some recordings and we will meet again
in the studio in November. He is supercool. So is Prince.
SZ: So you've also worked with Prince? The guy
just has offended the recordindustry again, in making his
new CD just an extra gift in a daily newspaper.
Will.i.am: A visionary. I performed on stage
with him. A few month ago I was with the Black Eyed peas in
Las Vegas. Prince called me, while he was gambling in a Casino:
" Hey, do you wanna perform with me today?" "Sure",
I said, "of cuz!" The next day an assistant of Prince
called and said: "Prince would like to know, if you'd
like to perform with him again this evening." if I would
like? What's cooler than to perform with Prince? Exactly:
Two days in a row to perform with him! A few minutes later
I got another call: "Hey this is Mike! What are you doing
around?" Mike? Michael Jackson? Wow! He had changed the
studio around that time from Ireland to Las Vegas. So I said:
" Hey, I'm performing with Prince here this evening!"
- "Prince? That's great!" - "You should be
there!" - "Really? You think that would be cool?"
- "That would be so damn cool!" - "Okay, then
I'll be there also." You must imagine that: I'm performing
with Prince and Michael will be there in the audience! Holy
shit! How likely it is, that a person first gets a call from
Prince and only minutes later Michael Jackson calls?
SZ: The likelihood should be around zero.
Will.i.am: Exactly. Okay so in the early evening
I'm on my way to the concert and - stuck in the traffic! F
! % K, I think, there is no worse moment possible to stick
in a traffic jam? So I'm jumping out of my car and start running.
I make it in time in the last second into the club. Everything
goes wonderful, after three minutes I'm going off stage, Prince
shouts into his microphone: " Give it up for Will.i.am!"
and I sneak through the hall and sit down at the table of
- Michael Jackson. He really attended! "How did you like
me?" I ask him. He answers: "I didn't know at all
that you're rapping." What? The guy let me come to Ireland
and he didn't know that I'm not only a producer but also a
rapper! I said: "You're never hearing my music, never
watching my videos? I'm the damn main rapper of the Black
Eyed Peas!" Anyway. Aside from Michael Jackson is sitting
the actor Chris Tucker und then Prince comes down from the
stage right into our direction...
SZ: ... and see Michael Jackson at the table
with you?
Will.i.am: Yo. He wears his bass with its belt
and stops in front of our table. So there are sitting: Michael
Jackson, Chris Tucker and me. Prince stands right in front
of Michael and improvises on his bass: slap! He's not doing
anything else, nothing else! Doesn't say a thing. He's just
playing! What a scene. After Prince returned to the stage,
Michael says to me: " Prince has played his bass right
into my face! What the heck?" Well, I say: "You're
incognito! Imagine Prince had said: 'Yay and you know Michael
Jackson is sitting here.' Ppl were already crazy cuz of Prince
but would have been completely out of mind if they'd have
known you were here also." Well that was the craziest
night of my life!
SZ: And if you tell the story, nobody believes
you.
Will.i.am: I wouldn't believe it myself! But
what can I say: It's true. Every word. The next morning I
had breakfast with Michael Jackson, we worked a bit on some
songs - and that was the last time I've seen him.

J5 MUSIC?
|
|
NOTE : JANET JACKSON WAS NOT PART OF J5!
Richard Altomare, the boss of luggage movement
company Universal Express, bought a collection of unclaimed
personal belongings from the warehouse. When he was going
through the belongings he discovered tapes reported to contain
almost 60 unreleased songs by The Jackson 5.
Reportedly, Altomare is negotiating with Sony
as well as Michael and Janet Jackson in hopes of releasing
the material:
"I've personally talked to Michael and
Janet on the phone about the tapes, and even played on a couple
of songs for them. At first there was silence on the other
end of the line, but that was quickly followed by giggles
as if it brought them back to the day those songs were recorded."

ROGER FRIEDMAN
|
|
FOR IMMEDIATE RELEASE: A call to action to support Michael
Jackson.
From Louis Flores, 'Michael Jackson Conspiracy' Assistant.
To our friends and supporters,
This is what it looks like when a reporter won't
come clean and admit to his bias against Mr. Jackson: a mess
is created that continues to do real injury to Michael Jackson's
public image. Raymone Bain is entirely right to defend Mr.
Jackson. Not only is it her job, but she believes that the
press must be held accountable when they intentionally rely
on “faulty” sources. This is like playing a dangerous
game of hit-and-run in the media. A reporter such as Roger
Friedman figuratively runs over Michael Jackson’s reputation,
and then he speeds away from the proverbial crime scene.
The media must be put on notice that "complete
lies," "untruths," and other distortions cannot
intentionally be published forever. That’s what Mr.
Friedman thinks. Perhaps he thinks it is a twisted and fun
game to print lies and half-truths – and then to provoke
Ms. Bain into calling him on his act. He is like a child who
can't keep his hand out of the cookie jar.
On behalf of Michael Jackson, I am calling on
those of you who are capable of doing so, to please buy a
copy of Michael Jackson Conspiracy and mail it to Mr. Friedman
at FOX News. This book actually tells the truth about Michael’s
innocence! If enough people send copies of the book to Roger
Freidman, then maybe he’ll actually read it –
and stop spreading falsehoods, while pretending that he doesn’t
know the truth about the 2005 trial.
Please mail a copy of Michael Jackson Conspiracy
to the address provided below:
Mr. Roger Friedman

Thus far, those of you who have joined our movement already
know that it is possible for a mainstream reporter to alter
the perception of Michael Jackson. It is now time to use the
evidence that Ms. Jones has collected in Michael Jackson Conspiracy
against all the hold-outs in the mainstream media, who continue
to let their pre-conceived notions creep into their media
reports about Michael Jackson.
Yours sincerely,

RAYMONE BAIN RESPONDS TO "UNTRUTHS"
Letter to Roger Friedman states that Mr. Friedman relies on
unbelievable sources
Exposes the “complete lie” about a Michael Jackson,
Marion Barry connection
Ms. Bain demands a retraction
August 15, 2007
Roger:
In your column dated August 14, 2007, you indicate that Michael
Jackson is "homeless, carting around w/ three school-aged
kids ... but, Michael Jackson has a new friend: former imprisoned
crack addict and Washington, D.C. Mayor Marion Barry."
And, you state further that I introduced the two of them.
All of this, Roger, is a complete lie. I do not know who
your sources are, or why you continue to believe them. I do
not know why you continue to write untruths which can be verified
as untruths. I do not know why you do not check to determine
the accuracy of your sources. And, I do not know why you have
such venom for Michael Jackson. But, let me state for the
record:
1) FACT: Michael Jackson has neither met, nor does he know
Former Washington, D.C. Mayor Marion S. Barry, Jr., neither
has he been in his presence while on the East Coast, and vice-versa.
PERIOD.
2) FACT: While Former Mayor Barry and I are friends, and,
while we have oftentimes indicated our desire to have lunch,
because of schedule conflicts, I have not seen him in at least
two years.
3) FACT: "Michael Jackson is not homeless, carting around
with three school-aged kids....." While where Mr. Jackson
is currently residing is his own private business, Mr. Jackson
will never be "homeless" as long as he owns the
3,000 acre estate called Neverland Valley Ranch, which to
my knowledge, and at this date, he has not sold. Mr. Jackson
has a tutor for his children who is certified and qualified.
As we are in the summer months, and most children in the United
States are on vacation until classes begin later in the month,
the same applies to Mr. Jackson's children
I will let Mr. Jackson's attorneys deal with other issues
you have raised should they see fit; and, I will let Marion
Barry deal with your portrayal of him, should he see fit.
But I find it unbelievable that you dedicated almost your
entire column on background of Marion Barry when neither he
or Michael Jackson have met.
I am respectfully requesting an immediate retraction regarding
the issues I have previously outlined.
Thank you very much for your attention and cooperation.
Raymone K. Bain

LA Judges Denies Womans Custody
|
|
A London woman who claims she is the real mother
of Michael Jackson’s three children was denied a role
Wednesday in the singer’s custody settlement with his
ex-wife, Deborah Rowe.
Nona Paris Lola Jackson, 36, asked a judge to
grant her joint physical custody of Jackson’s 10-year-old
son, Prince Michael, and 9-year-old daughter, Paris. She also
claims to be the mother of 5-year-old Prince Michael II.
“I feel her evidence fails to establish
any genetic relationship between herself and the Jackson-Rowe
children,” Superior Court Judge Robert A. Schnider said.
Schnider also denied the woman’s request
to nullify Jackson’s marriages with Rowe and with Lisa
Marie Presley, both of which ended in divorce.
Nona Jackson was heard in the courtroom through
a telephone and loudspeaker. Jackson and Rowe were not present.
Jackson settled a custody fight with Rowe over
his two eldest children in September. Details of that agreement
have not been released. Jackson has not identified the mother
of Prince Michael II.
Nona Jackson sought joint physical custody of
the children while giving Jackson legal custody. In court
papers, she offered a tentative schedule for visits. She also
asked the court to grant her child support in an amount to
be determined by Jackson, along with possession of his Neverland
Ranch and a San Fernando Valley home.
“Debbie’s hospital records will
prove that my kids are not hers because of DNA,” she
stated.
In court papers, Nona Jackson contended that
“Michael and I are a sexually active couple and have
been this way from the beginning.” She also claimed
to have written more than 3,000 songs for him.
The woman’s three previous attempts to
have a say in the custody battle were rejected by the same
judge last November and in February and May on grounds that
she had failed to notify Jackson and Rowe of the hearings.
With Wednesday’s ruling, it was unclear
if she had any more legal options.
“I guess it’s possible she could
always do something else,” said Marta B. Almli, Rowe’s
attorney.

Michael Jackson sued by former lawyers
|
|
Michael Jackson's former entertainment lawyers
filed a lawsuit Tuesday claiming the singer owes them more
than $113,000.
The law firm Lavely & Singer of Los Angeles
says Jackson agreed in arbitration last year to pay them $180,000
in three installments.
Jackson failed to make the final payment of
$113,750 before the July 31, 2007, deadline stipulated in
the settlement, the firm alleges in a complaint filed in Los
Angeles Superior Court.
A message left for Jackson's publicist, Raymone
Bain, was not immediately returned Tuesday. His lawyer, Christopher
Mellott, could not be reached after hours Tuesday.
A judge last month ordered the 48-year-old pop
singer to pay more than $256,000 in legal fees to another
firm that handled some side issues during his 2005 child molestation
trial.
Jackson was acquitted of child molestation charges
in the case.

Miming in front of a mirror with a hairbrush
to his mouth the gangly Ilford teenager could never have imagined
he would one day enjoy the glittering popstar lifestyle of
the idol he adored.
As the world's best-known Michael Jackson impersonator,
Navi (as he prefers to be known) has tasted the sweet fruits
of pop superstardom without ever selling a single record,
but admits he was mocked for his dreams as a child and teenager.
One of eleven children, he could easily have
slipped into obscurity amidst the hustle and bustle of family
life, but a momentous decision made at a tender age, ensured
he would never be ignored again.
A tenacious dancer since childhood, Navi idolised
the new breed of popstar that appeared during the late 1970s
and early 1980s, who combined gymnastic physical routines
with powerful vocals during their performances.
David Bowie, Luther Vandross and Tina Turner
were early influences, but it wasn't until 1979, the year
his family emigrated from Trinidad to Britain, that Navi first
experienced the genius of Michael Jackson, the artist who
would come to define his life.
He said: "I was about six years old and
remember switching on the radio and hearing this incredible
sound which just made me want to dance.
advertisement"It was one of the tracks
from his early solo album, Off the Wall, and I pretty much
knew from that moment that I wanted to be just like him."
Navi's family, and Friends at Valentines High
School, in Cranbrook Road, teased him for seeking to emulate
the former Jackson 5 star, but were soon forced to take him
seriously.
He said: "My parents used to think I was
just going through a phase I would grow out of, but I knew
that I wanted to be a performer.
"I was about 15 years old when I entered,
and won, a Michael Jackson impersonation competition which
changed the way I saw myself.
"I'd always loved Michael Jackson and wanted
to be like him but I d never thought of impersonating him
professionally until that point."
Navi's adulation of Jackson was finally cemented
when he attended the momentous Bad tour in 1988, where he
was mesmerised by the singer's live routine.
Buoyed with confidence, the ambitious teenager
signed up with a talent agency as a Michael Jackson impersonator
and, after a disappointing spell advertising a brand of peanut
butter, was soon receiving a flood of glamorous bookings.
He said: "Things really started to take
off in the early 90s when I started to get well paid work,
such as being flown across Europe by Richard Branson to perform
at the opening of a load of his Virgin Megastores.
"It was like a dream being able to do precisely
what I love doing in front of large crowds of people - and
getting paid for it."
Navi, who has undergone extensive plastic surgery
to look more like the American superstar, admits his 19-year
career has had its fair share of strange moments.
He said: "I've been asked to do some really
varied things, from performing at working mens clubs up north
to singing at the birthday of a member of the royal family
of Bahrain.
"Perhaps the strangest gig I've ever had
was when Michael's people hired me to act as his body double
in 1993.
"They flew me to Thailand in an attempt
to divert press attention away from him during the court case
he was involved in at the time.
"Everyone genuinely thought I was the man
himself, and I was even pictured on the front cover of The
Times newspaper, supposedly as Michael Jackson, which was
totally bizarre."
The 34-year-old, who has visited Jackson at
his Neverland estate in California, admits he is glad he can
leave the world of pop superstardom behind whenever he chooses.
He said: "After experiencing certain aspects
of the life that Michael leads, I can genuinely say that I
don't envy him.
"He is a genius, and the best singer/-performer
there has ever been, but the price of that has been this unreal
world he lives in which he can never really escape.
"Some people like the champagne and caviar
thing, but I'm more of a kebab man myself."
The devout Christian, whose family are regular
worshippers at the City Gates Christian Centre, in High Road,
Ilford, recently performed to visitors at the Mauritian Cultural
Day in Lloyd's Park, Walthamstow.
Navi's next London performance will be at the
Hippodrome, Leicester Square, on Sunday, August 26, to celebrate
Michael Jackson's 49th birthday.

MJ & SONY sells Beatles song for use in diaper
ad
|
|
Superstar Michael Jackson (AND SONY!!!!) has
licensed the use of the Beatles' song All You Need Is Love
for a series of new advertisements - for a diaper company.
The Thriller hitmaker still has a stake in the
music publishing company Sony/ATV, which owns the rights to
the Fab Four's back catalogue.
But the company's decision to license the hit
All You Need Is Love to pharmaceutical and cosmetics firm
Proctor + Gamble is a "surprise" to John Lennon's
widow Yoko Ono, because they had always given her advance
notice of their intentions in the past.
The song will appear in adverts for the Luvs
branded diapers, according to the New York Daily News.
